In michigan it is a FELONY to chalenge someone to a duel, but only a misdamenor to accept one. :2gunsfiring:
you know of any odd laws like this?

Theft of 1,000 pieces of citrus is considered a felony of the 3rd degree. Less than that is a misdemeanor. Now is that like whole oranges and grapefruits or merely wedges and imagine if you were the cop who had to count it. Weird huh? "998 oranges...999 oranges and a...bananna. Sorry about that. You can go home now."

Here's a weird one too...I see a grey area maybe you guys can catch it too.

A person who possesses less than a gallon of "moonshine" is charged with a misdemeanor of the first degree...364 in county lockup.

A person who possesses more than a gallon of "moonshine" is charged with a felony of the third degree...5 years in State Prison.

Can you see the grey area? I'd still hate to test it though.

Ok. Less than a gallon is a misdemeanor, more than a gallon is a felony...what if I just had a measured gallon? I think someone in Florida Legislature screwed that up. As far as I could define it, if a person has just one measured gallon, I can't do a thing to them. Besides help them drink it a little.

LEO: "Well I see you know the law pretty well punk. Well Mr. smarty pants, you see if a guy were to take an orange, much like this one, and if he were to slice it in half, just like this, then I believe that would make 1000 pieces of citrus....who is laughing now FELON?!"

It is a slip on the State Legislature's fault for not catching that. But since the law is definitive in a trial, a good defense attorney could get a defendant's case dropped in a heartbeat. I'm sure someone will fix it one day.

Well I wonder if it was actually a slip up ? I mean it is possible that exactly 1 gallon was left out of the law intentionally. Afterall it wouldn't be the first time a loop hole was put in for the sake of a lawmaker getting away with something. And I know it sounds like a joke, but how many times have we seen lawmakers get away with something because of a loop hole in laws that they created ?

They haven't changed a word of it since I came too FL. There aren't too many illegal stills here anymore. You don't find too many moonshiners out in the woods cooking up corn mash and if it did...I'd suppose someone from ATF or Alcohol Law Enforcement (ALE) team would have jursidiciton. It's getting too jammed packed with folks here. After two more tours, I'm moving to a gun friendly state that doesn't snow often. Getting sick of the crime rate here, the ass backward State Legistlature, the rising property taxes and less and less open space for a man to enjoy.

I guess we had better start digging into all of the laws that Senator Larry Craig sponsored huh? Another one bites the dust....(politician that is)
